The Gurnee Police Department is committed to enforcing Illinois law while maintaining trust within our community. The information below explains how Illinois law governs local law enforcement interaction with federal immigration authorities.
The Gurnee Police Department does not inquire about, investigate, or act upon an individual’s immigration status.
| Enforce State and Local Laws The Illinois Trust Act does not restrict officers from enforcing state statutes or local ordinances. Respond to Emergencies Police will always respond to 911 calls and provide assistance in emergencies. Immigration status is not questioned or considered during these responses. Comply with Federal Criminal Warrants Officers may act on a valid federal criminal warrant that has been signed by a judge; the state restrictions apply only to civil immigration matters, not criminal proceedings. |
| Detain Individuals for Civil Immigration Violations Officers cannot hold someone for Immigration and Customs Enforcement (ICE) based on a civil detainer or administrative warrant. Provide Access to Individuals in Custody Immigration agents may not be granted in-person or telephone access to individuals held in local custody. Transfer Custody to ICE Local officers are not permitted to release or transfer individuals into the custody of federal immigration authorities. Assist with Immigration Enforcement Operations This includes providing transportation, setting up perimeters, or allowing the use of local facilities for immigration enforcement purposes. Grant Access to Nonpublic Databases Local police cannot share or provide ICE with access to databases that are not publicly available.
